Same Sex De Facto Relationships

Under the Family Law Act the laws about the division of property, maintenance and children’s issues for same sex couples is now largely the same as for married couples.

The Family Law Act will generally apply if you separated on or after 1st March, 2009 except for relationships in Western Australia. Where separation occurs prior to March 2009, state de facto law generally applies.
